General Terms and Conditions (GTC)

§1 Scope of Application

(1) These General Terms and Conditions (GTC) apply to all contracts concluded between V-IZ – Video Language Center, owner Fuat Karacocuk (hereinafter referred to as the “Provider”), and customers (hereinafter referred to as the “User”) concerning the booking and use of digital language-learning offers (video courses) and related materials provided via the website www.v-iz.com.
(2) Any terms and conditions of the User that deviate from, contradict or supplement these GTC shall not apply unless expressly approved in writing by the Provider.

 

§2 Subject Matter of the Contract

(1) The contract covers access to a digital language-learning program (“Video Course”) consisting of:

  • up to seven modules (A1 to B1),

  • approx. 80 hours of video material per module (≈ 100 teaching units),

  • interactive online tests and exercises (approx. 200 tasks per module),

  • a printed course book (Schritte plus neu, Hueber Verlag, included in the price),

  • access to a password-protected learning platform (Moodle) with a personal user account.

(2) The course content is based on the Common European Framework of Reference for Languages (CEFR).
(3) The courses are not state-funded or approved by the Federal Office for Migration and Refugees (BAMF).
(4) Access is granted via a monthly subscription or one-time payment, depending on the User’s selection.

 

§3 Conclusion of Contract

(1) The contract is concluded when the User clicks the button “Purchase now” (or equivalent wording) during the checkout process and the payment transaction via Stripe, Wix Payments, PayPal or Klarna is successfully completed.
(2) After purchase, the User automatically receives:

  • a digital invoice (issued via Wix), and

  • an e-mail containing login details for the Moodle learning platform.

(3) The contract is concluded digitally; no handwritten signature is required.

 

§4 Prices and Payment

(1) The price per module is €34.99 per month (subscription, cancellable at any time) or €199.99 as a one-time payment.
(2) The price includes:

  • full access to the online platform,

  • use of all videos, tests and exercises,

  • free shipment of one printed course book per module.

(3) All payments are processed exclusively through Stripe, Wix Payments, PayPal, or Klarna.

(4) Payment data is not stored by the Provider. All payment processing is handled by the respective payment service provider.

(5) The payment becomes due immediately upon contract conclusion and repeats automatically for each subscription cycle unless cancelled.

 

§5 Service Delivery

(1) Access to the Moodle platform is activated immediately after receipt of payment.
(2) The printed course book is shipped within 3–5 business days within Germany or 10–15 business days to other EU countries.
(3) Delivery delays caused by shipping providers (e.g., DHL, DPD) are beyond the Provider’s control and do not entitle the User to refunds or compensation.

 

§6 Copyright and Usage Restrictions

(1) All course content (videos, texts, exercises, tests, platform structure, and layout) as well as the delivered course book are protected by copyright law (§§ 2 ff. UrhG).
(2) The User is granted a simple, non-transferable right to use the content solely for private educational purposes.
(3) The following actions are strictly prohibited:

  • downloading, copying, or redistributing course videos or materials,

  • uploading videos or materials to third-party platforms (e.g., YouTube, Vimeo, etc.),

  • creating or sharing screen recordings or screenshots,

  • duplicating or distributing the printed course book,

  • sharing personal login credentials with third parties.

(4) To detect misuse, the Provider uses technical monitoring measures (e.g., IP address checks, login frequency analysis, hash verification).

(5) Violations result in immediate account suspension, permanent exclusion from the platform, and may lead to civil or criminal prosecution and claims for damages.

 

§7 Right of Withdrawal and Refund Policy

(1) In accordance with §356(5) BGB, the User’s right of withdrawal expires once the User expressly agrees to the Provider starting the contract performance before the expiry of the withdrawal period and the User starts playing the first video.
(2) Once the digital content has been accessed, refunds are excluded.
(3) For the shipped course book, the statutory withdrawal right (§355 BGB) applies. The User has the right to withdraw within 14 days without stating reasons. Return shipping costs are borne by the User. Opened or damaged books may be subject to a compensation payment (§357(7) BGB).
(4) Damaged or defective books will be replaced free of charge.

 

§8 User Obligations

(1) The User shall:

  • keep login credentials confidential,

  • refrain from violating copyright or data protection laws,

  • behave respectfully on the learning platform,

  • not use automated bots, crawlers, or unauthorized third-party software.

(2) Violations of these obligations entitle the Provider to suspend or terminate access without any refund claim.

 

§9 Liability

(1) The Provider shall be liable without limitation for damages caused intentionally or by gross negligence.
(2) In cases of slight negligence, the Provider shall be liable only for the breach of essential contractual obligations (“cardinal obligations”), and such liability shall be limited to the typical and foreseeable damage.
(3) Liability for injury to life, body, or health remains unaffected.
(4) Any further liability of the Provider is excluded.

 

§10 Data Protection

(1) The Provider processes personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
(2) To perform the contract, the following data transfers occur:

  • to shipping companies (e.g., DHL, DPD) for book delivery (name, delivery address),

  • to payment service providers (e.g., Stripe, Wix Payments, PayPal, Klarna) for payment processing (name, e-mail, payment amount).

(3) The Provider itself does not store payment or card data.

(4) Any further data disclosure occurs only if required by law.

§11 ZFU Approval Process (FernUSG Compliance)

(1) In accordance with the German Distance Learning Protection Act (FernUSG), the Provider has initiated the approval process with the State Central Office for Distance Learning (ZFU).
(2) The official ZFU approval is currently in progress.
(3) All courses can be fully used during this approval process.
(4) Once approval is granted, the official ZFU registration number will be added to the course information.
(5) The validity of existing contracts remains unaffected.

 

§12 Final Provisions

(1) German law shall apply. The mandatory consumer protection regulations of the User’s country of residence remain unaffected.
(2) Place of performance and jurisdiction for all disputes, to the extent legally permissible, is Mannheim, Germany.
(3) Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. In such cases, the statutory provision shall apply in place of the invalid clause.
(4) The European Commission provides an Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.
(5) The Provider is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

 

§13 Special Provisions for Corporate Clients (B2B)

(1) Companies may book multiple employee accounts under one collective agreement. Each employee receives an individual Moodle login.
(2) The contracting party remains the company, which is responsible for ensuring compliance with these GTC by all registered users.
(3) Upon request, the Provider issues consolidated invoices (monthly or quarterly).
(4) Termination of corporate subscriptions must be made in writing and applies to all associated accounts unless agreed otherwise.
(5) The transfer or sharing of user accounts with non-registered employees or third parties is strictly prohibited.
